1. Introduction

We are Flowerscapes Rentals LLC (“we,” “us,” “our”).

We operate https://www.flowerscapes.rentals (the “Site”, “website”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”, “customer”), and Flowerscapes Rentals LLC, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We will provide you with prior notice of any scheduled changes to the Services you are using. The modified Legal Terms will become effective upon posting or notifying you by flowerscapesrentals@gmail.com, as stated in the email message. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms.

Services are intended for users who are at least 18 years old. Persons under the age of 21 are not permitted to use or register for the Services.

We recommend that you print a copy of these Legal Terms for your records.

2. Rental Process

You agree to rent artificial floral arrangements (“rental items”) from us for your specified event, as outlined in your rental order. By completing the rental process and providing payment information, you confirm your rental order.

3. Rental Period

The rental period commences and concludes on the date specified in your rental contract. You are responsible for returning the rental items in the condition in which they were received, accounting for ordinary wear and tear. Please be aware that late returns will incur an additional fee equal to 50% of the complete rental price of each item per day.

4. Payment, Rescheduling, and Cancellation Policies

Payment: You agree to make a deposit of non-refundable 25% of the rental amount and the rest of the rental amount a month before your scheduled event date.

Rescheduling: If you need to reschedule your event and provide us with at least 30 days' notice prior to the original event date, the amount previously paid will be applied to the new event date.

Cancellation Policy: If you decide to cancel your rental order, the following refund policy applies:

• Cancellation 60 Days or More Prior to Event Date: If you cancel your order 60 days or more before the event date, a non-refundable fee equivalent to 25% of the full rental amount will be retained, and the remaining balance will be refunded to you.
• Cancellation Less than 60 Days Prior to Event Date: If you cancel your order less than 60 days prior to the event date, no refunds will be provided, and the full rental amount will be retained.

Please note that the non-refundable fee for cancellations made 60 days or more prior to the event date is intended to cover administrative and processing costs associated with your order. We recommend reviewing your event plans carefully and notifying us promptly if you need to make any changes or reschedule to avoid cancellation fees.

By using our rental services and making payments, you agree to comply with these payment and refund terms. This policy is designed to ensure fair treatment for both our customers and our business.

5. Damage or Loss

You are responsible for any damage to or loss of the rented floral arrangements during the rental period. In case of damage or loss beyond normal wear and tear, you may be charged for repair or replacement costs. In the event of damage equal to or exceeding 50% of the rental item's value, you will be charged up to four times the original rental price. In such cases, you will also be allowed to keep the damaged item.

Additionally, our products are not waterproof nor fireproof. In the event of rain, we will bring the rental items indoors.

6. Prohibited Activities

You agree not to misuse our Services, including but not limited to:

• Using the floral arrangements for purposes other than those intended.
• Attempting to reverse engineer, modify, or replicate our floral arrangements.
• Interfering with the proper functioning of our website or services.
• Engaging in any unlawful activities related to our Services.

7. Termination

We reserve the right to terminate the rental agreement for violation of these Terms or any applicable laws or regulations, as outlined in this Contract. While we make every effort to meet your desires and requirements, there may be situations where we are unable to fulfill your specific request or desire. In such cases, we reserve the right to terminate the rental agreement.

8. Delivery, Setup, Repurpose and Teardown

We agree to deliver, setup, repurpose and teardown the rental items after the event at the venue location specified in your rental agreement. It is your responsibility to ensure the accuracy and accessibility of the provided address. We are not responsible if the rental items do not fully fit in your home or venue. You may not move or alter the arrangements without our prior consent.

If ceremony and reception are at the same venue, repurposing is complementary. Otherwise, additional fee might be applied. Flower arrangements that were used during ceremony can be repurposed to reception as follows:

• Arches can be relocated behind the sweetheart table or cake table
• Aisle flowers can be moved to:
  • Front of sweetheart table or cake table (floor level only, not on table surfaces due to their size and design)
  • Stairways
  • Mantles
  • Welcome sign area
  • Other suitable locations as determined during setup

9. Liability

We are not responsible for any delays, failure to deliver, or inability to fulfill this contract due to circumstances beyond our reasonable control, including but not limited to illness, accidents, extreme weather conditions, natural disasters, transportation disruptions, or other unforeseen events. In the event that we are unable to fulfill our obligations, we will make reasonable efforts to find a suitable replacement or offer a refund. However, our liability is strictly limited to the amount of monies paid under this contract, and we are not liable for any indirect or consequential damages resulting from such circumstances.
